Chicago Man Sentenced to 58 Years for Domestic Violence Attack in Fond du Lac

(FOND DU LAC) A Chicago man who tried to kill a woman in a brutal domestic violence attack in Fond du Lac has been sentenced to 58 years in prison.

Lataye D. Smith, 48, was convicted by a jury of attempted homicide, mayhem, and battery, all involving the use of a dangerous weapon.

Prosecutors say Smith slashed the victim’s throat and wrist with a box cutter inside a car in January 2023. The woman fought him off and ran to safety at the Fond du Lac Police Department. Officers found blood inside and near the victim’s vehicle, along with a canister of mace she dropped while fleeing.

Fond du Lac County District Attorney Eric Toney called the case a stark reminder of the importance of protecting victims of domestic violence.

“Every woman and person has a right to be safe in their relationship,” Toney said. “This defendant attempted to steal her right to safety, and he will now be spending 58 years in prison.”

Toney urged anyone experiencing domestic violence to reach out for help by calling 1-800-799-SAFE (7233), texting “START” to 88788, or contacting the local Solutions Center at 920-923-1700.

The court’s sentence includes 58 years of initial confinement and 38 years of extended supervision. The District Attorney’s Office and the victim had requested the maximum penalty of 83 years.

The case was investigated by the Fond du Lac Police Department and prosecuted by District Attorney Eric Toney.
