Rubicon Man Sentenced To Ten Years In Prison For Intimidating A Victim And Fifth Offense OWI

(Juneau) A Rubicon man was sentenced to ten years in prison Monday on a variety of different crimes. Earl Captain plead no contest to felony counts of Operating While Under the Influence Fifth Offense, Intimidation of a Victim and Bail Jumping. Last October, deputies with the Dodge County Sheriff’s Office were dispatched after receiving phone calls from a woman claiming that Captain was drunk, had hit her, pointed a firearm at her and threatened to kill her if she called police. After safely removing the women from Captain’s home, authorities were able to restrain and arrest Captain. Two months after posting a $2,500 cash bond for his release, Captain showed up to the women’s residence drunk and armed with a firearm. Captain was placed on a $10,000 bond, which he also posted, and was ordered to not consumer alcohol but a few months later was arrested for his fifth OWI. A witness reported that Captain swerved into oncoming traffic. Bond was set at $100,000 in March and Captain has been behind bars since then. Dodge County Assistant District Attorney James Sempf, who prosecuted the case, said at sentencing that Captain has demonstrated that he is a danger to the community. Sempf added that there needs to be incarceration in order to protect the public. In addition to prison, the 54-year-old was placed on probation for three years.
