(Juneau) Probable cause was found this week for a Juneau man who was out on bail for First-Degree Child Sexual Assault and is accused to have again made inappropriate contact with a minor to head to trial. Joel Birky was in court this week for his preliminary hearing on additional felony charges of Second-Degree Child Sexual Assault and Child Enticement.
In July, the 15-year-old victim and her parents reported the alleged assault to Juneau police. According to the complaint, Birky took the victim and her brother roller skating on July 2nd. Early the next morning, Birky reportedly assaulted the victim.
The 37-year-old was charged in May with a number of child sexual assault offenses. In that case, the eight-year-old victim reported staying at Birky’s Juneau home between Christmas and New Year’s Day. She allegedly said Birky made inappropriate contact multiple times and stated that he pinned her down.
A $5,000 cash bond was signed by Birky and he was required to have no unsupervised contact with minors as part of his bail conditions. Birky faces up to 215 years in prison on those charges.
If convicted in the most recent case, Birky is facing an additional 117 years behind bars. An arraignment hearing is scheduled for September 5th.
